Alaska Constitution

Art. I. Declaration of Rights

§ 25. Marriage

To be valid or recognized in this State, a marriage may exist only between one man and one woman.

Approved 1998. Effective Jan. 3, 1999.

Note

As approved by the legislature, the amendment read: “To be valid or recognized in this State, a marriage may exist only between one man and one woman. No provision of this constitution may be interpreted to require the State to recognize or permit marriage between individuals of the same sex.” The state supreme court struck the second sentence in Bess v. Ulmer, 985 P.2d 979, 988 (Alaska 1998).
